ACTEON GROUP – GENERAL CONDITIONS OF USE OF THE WEBSITE

1.    GENERAL PROVISIONS – DEFINITIONS

  1. These general conditions of use of the website (the « GCU ») govern any use by the USER of the website (the « WEBSITE ») belonging to the PUBLISHER.
    1. The fact that the USER accesses the WEBSITE implies acceptance of the GCU and waiver of any general conditions of use or other document or stipulation contradicting the GCU.
    1. Definitions :
  2. « USER » means the user of the WEBSITE.
  3. « PUBLISHER » means FINAPOLLINE SAS, holding of ACTEON Group.

The PUBLISHER acts on behalf of its affiliated company, where affiliated companies are companies more than 50% owned or controlled by the PUBLISHER together “ACTEON Group” or the “Group”.

The USER declares and is presumed to be a health professional.

2.    USE OF THE WEBSITE

  • The purpose of the WEBSITE is to present the products sold by ACTEON Group and to provide information of the Group’s various actions. Through the WEBSITE, the USER may create a personal space to request to be contacted by an advisor, to receive the Group’s newsletter or to obtain documentation on the products or other services, in this respect, he will be asked to fill in a contact form or to create a personal account for which he may give personal information.
    • The USER is responsible for the accuracy of the information he enters in the WEBSITE forms.
    • The USER shall be responsible for maintaining the confidentiality of the login of his personal space.
    • The USER shall use the WEBSITE in accordance with the provisions and instructions for use and security contained in the GCU. The USER shall not attempt to interfere with the proper functioning of the WEBSITE. Failure to do so may result in the USER’s liability being incurred.

3.    INTELLECTUAL PROPERTY

3.1     The content of the WEBSITE is the property of the PUBLISHER. The USER has the authorization to consult the data which it contains for his only personal non-commercial use, which excludes any commercial exploitation at a local, national, or international level. In particular, no logo, text, sound, graphic or image contained on the WEBSITE could be copied, reproduced, modified, published, issued, posted, transmitted or distributed by any means whatsoever, without the prior written authorization of the PUBLISHER.

3.2     In accordance with the article L. 122-5 of the French Code of the Intellectual Property, the USER has a right of partial reproduction of the articles of the WEBSITE, for educational purposes, subject to the  respect of the following obligations : the mentions of the name of the author, the respect of the integrity of the article (no alteration, with the exception of partials quotations), the free distribution, the mention of the source of the document, appearing in very apparent characters, and this worded « This document comes from the website of ACTEON Group – www.acteongroup.com – All rights of representation and reproduction are reserved. » .

4.    LIABILITY

4.1     No liability of the PUBLISHER can result from the use of the WEBSITE.

4.2     The PUBLISHER makes all reasonable effort for the good functioning of the WEBSITE and the update of the information contained on the WEBSITE. However, the PUBLISHER will not be held liable in case of inaccessibility of the WEBSITE and/or of inaccuracy of the information contained in the WEBSITE.

5.    PERSONAL DATA

The PUBLISHER and its affiliated companies are the joint data controllers regarding the processing of the USER’s personal data. These data will be treated in accordance with the General Data Protection Regulation (Regulation EU 2016/679). The objective of the treatment is to allow the USER to reach the services proposed by the WEBSITE. The PUBLISHER and its affiliated companies are the only recipients of the data, which will not be communicated to third parties, except under legal obligation. The PUBLISHER undertakes to take the necessary measures regarding data transfers outside the EU between its European affiliated companies and its non-European affiliated companies.

The data will be kept for three years from the last contact. The data will be deleted by appropriate security measures. The USER may exercise his or her rights of access, rectification, and deletion by contacting FINAPOLLINE SAS, Legal Department, 17 avenue Gustave Eiffel, ZI du Phare, 33700 Mérignac, FRANCE, protectiondonnees@acteongroup.com. 6.    APPLICABLE LAW – LANGUAGE – DISPUTE RESOLUTION

THESE GCU ARE GOVERNED TO THE FRENCH LAW.

THE LANGUAGE OF THE GCU IS THE LANGUAGE OF THE WEBSITE; IN CASE OF CONTRADICTION WITH A VERSION IN ANOTHER LANGUAGE, THE VERSION IN THE FRENCH LANGUAGE WILL PREVAIL.

ANY DISPUTE ARISING IN CONNECTION WITH THESE GCU WHICH IS NOT AMICABLY RESOLVED WITHIN 30 DAYS FROM ITS NOTIFICATION, SHALL BE SETTLED BY THE COURTS OF BORDEAUX, FRANCE, NOTWITHSTANDING ANY THIRD-PARTY CLAIM, PLURALITY OF DEFENDANTS OR CONNEXITY, AND EVEN FOR PROCEEDINGS FOR CONSERVATORY OR PROVISIONAL RELIEF (REFERE) OR BY REQUEST (PAR REQUETE).
